What Is an Architect of Record?

The architect of record is the licensed architect who seals the architectural construction documents and is responsible for that design’s conformance with applicable codes and the professional standard of care. Other designers may shape the project. The seal says who is responsible for the documents.

Architect of Record

Large projects sometimes split a design architect, who leads the concept and image, from an architect of record, who produces and seals the construction documents in the project’s jurisdiction and often performs construction administration. The AOR must be licensed where the building is. Sealing is not a graphic. It is the professional’s statement that they are in responsible control of that work. Engineers of record do the same for structural, mechanical, electrical, and other engineered documents. The AOR does not seal their engineering. An unlicensed firm, a contractor, or a design architect working outside their license cannot borrow the AOR’s seal to cover work the AOR did not control.

The seal means responsible control

Licensing boards require the sealing architect to have responsible control over the documents. That means they directed the work, reviewed it, and can answer for it. Rubber-stamping another firm’s set, or sealing sheets they did not review, is a license problem and a liability problem. Owners should be able to name the AOR at the time the CD contract is signed.

The standard of care is professional skill and care ordinarily provided on similar projects, not a guarantee that the building will be perfect or that the cost will match an early estimate. The construction contract, not the architect’s seal, is what obligates the contractor to build what the documents show.

Design architect and AOR can be two contracts

A design architect may be hired for schematic design and a signature building image, especially when they are not licensed in the state or do not provide construction documents. The AOR then develops and seals the set, and should have a defined handoff: what was decided, what is still open, and who answers design-intent questions during CA. A vague handoff produces two architects and no decision.

Some firms use "executive architect" for the local sealing role. Treat it as a scope question. If that firm seals, they are the architect of record whatever the proposal calls them. If they only coordinate consultants and do not seal, someone else is, and that someone else needs a fee that covers the responsibility.

Consultants seal their own work

The structural, MEP, and civil engineers of record seal their sheets. The AOR typically coordinates the consultant set and may contract them as subconsultants. Coordination is not authorship. An architectural detail that changes a structural condition has to go through the structural engineer of record. The AOR cannot "cover it" with an architectural seal.

During construction, RFIs follow the discipline. The AOR routes structural questions to the structural EOR and answers architectural ones. A single inbox without that routing looks efficient and produces answers from the wrong license.

Record responsibility continues into construction

The AOR’s construction administration interprets the architectural documents, reviews architectural submittals, and joins substantial completion. Leaving CA to a different firm than the sealing firm can be done, and it needs a written transfer of information and a clear line on who may revise the sealed set. Revisions to sealed documents are made by the professional who seals the revision.

On design-build, the AOR may contract with the design-builder rather than the owner. The duty to the public and the license does not disappear because the client changed. Owners should still know the AOR’s name. Instructions that ask the AOR to hide scope from the documents are not a normal commercial request. They are a request to seal something that is not the design.
